Nell’affrontare la recente giurisprudenza sulla responsabilità delle banche nel finanziamento delle imprese in crisi, alla luce del diritto europeo e nazionale, il saggio intende evidenziare il ruolo delle policy adottate da ciascuna banca al fine di ricondurre il sindacato giurisdizionale nell’ambito del Rescue judgement rule.

By addressing the recent case law on the liability of the banks in the financing of enterprises in crisis, on the ground of European and national law, the essay aims to highlight the role of the policies adopted by each bank in order to bring judicial review within the scope drawn by the Rescue judgment rule.
