Il single rulebook per il settore bancario dell’Unione europea: un originale strumento regolatorio
Il saggio esamina un tema finora poco studiato dai giuristi, ma di rilevante valore operativo. Si tratta del Single Rulebook, che per il settore bancario è una sorta di testo unico normativo europeo. Per la prima volta sono identificati i principali caratteri giuridici di questo strumento. La conclusione è che pare opportuna una più chiara definizione nel quadro degli strumenti regolatori dell’unione bancaria europea, per assicurare certezza agli operatori del settore e coerenza nella giurisprudenza dei giudici dell’Unione.

The essay examines a topic that has so far been little studied by jurists, but of significant operational value. This is the Single Rulebook, which for the banking sector is a sort of single European regulatory text. For the first time the main legal characteristics of this instrument are identified. The conclusion is that a clearer definition seems appropriate within the framework of the regulatory instruments of the European banking union, to ensure certainty for operators in the sector and coherence in the jurisprudence of the Union judges
